1. General provisions

1.1 The website www.belgian-sworn-translator.be is the property of Traductoris.com, duly represented by Cornelia RADU, MSc ME. Traductoris.com works in collaboration with non-profit organisation (ASBL) Productions Associées, having its head office in 1060 Brussels, Belgium, VAT: BE 0896.755.397.

1.2 These conditions for website registration apply to all commercial transactions and relations between Traductoris.com, owner and administrator of the website www.belgian-sworn-translator.be, referred as the “COMPANY” below ON THE ONE HAND and the sworn translator registering on the website, referred to as the “TRANSLATOR” ON THE OTHER.

1.3 All sworn translators with a Belgian Court of Justice can register on this website. They have free decision regarding their rates and conditions for every order, as we do not act as intermediaries.  

1.4 The translator is free to put an end to his registration at any time and without justification.

1.5 The websites www.traducteur-jure-belge.be, www.belgische-beedigde-vertaler.be, www.traducteur-interprete-belge.be and www.belgische-vertaler-tolk.be are the French and Dutch versions of www.belgian-sworn-translator.be and www.belgian-translator-interpreter.be without being identical copies. The differences are due to the decision of some translators not to be present in all these directories and in all available languages.

1.6 Sworn translators who also are interpreters (sworn or not sworn) in Belgium can register on both websites : www.belgian-sworn-translator.be and www.belgian-translator-interpreter.be and on their French and Dutch versions (please see previous paragraph and paragraph 3.3).

1.7 This website’s purpose is to provide the translator with:

a. The possibility to increase his revenue thanks to his/her registration on this website;

b. A personal web space on www.belgian-sworn-translator.be, for increased visibility on the Internet;

c. A new means to be easily found and contacted by the people and companies needing a sworn translator;

d. Better visibility on the translation market thanks to assessment and referencing made by clients.

2. Rights and obligations of the translator

2.1 All translators sworn by a Belgian court of Justice can register on this website for 1 year (12 months from the date on which the registration takes effect), or more. The exact duration of the registration is in accordance with the Registration Form completed, dated and signed by the translator at the time of registration.

2.2 The translator is free to take on (or not) requests from clients and to set up his own delivery and payment conditions for each translation he makes.

2.3 To register, the translator will download the Registration Form from the "Registration" page of these directories. This form, completed, dated, signed by the translator, will be sent by email to the following address: registration@belgian-sworn-translator.be. The translator will receive a confirmation email within 24 hours.

2.4 The individual pages will be created, published on Internet and an invoice will be sent to the translator only upon reception of:

2.4.1. The Registration Form duly filled-in, dated and signed by the translator;

2.4.2. The payment to the account mentioned in the Registration Form ;

2.4.3. A copy of the decision of a Belgian Court of Justice that the respective translator is a sworn translator (and/or sworn interpreter).

Sworn translators in other countries of the European Union who wish to work as sworn translators in Belgium are subject to special conditions. The respective translators are invited to contact the Belgian Ministry of Justice to comply with the conditions concerning them, in their specific situation.

2.5 The translator's data may also be mentioned, against payment of additional advertising costs, in the existing advertising sections in this directory:

2.5.1. In the column on the left with the individual banners;

2.5.2. In the column on the right: "Featured translators";

2.5.3. In the photo gallery, at the top of the pages.

2.6 These advertising fees are in addition to the registration fees mentioned in points 3.2 and 3.3. Details of advertising rates are available in the Registration Form and on the page Registration Fees.

2.7 If the translator has his own website, a link will be made to it only if:

2.7.1 His site is secure, i. e. it will be https://... instead of http:/...

2.7.2 After having introduced on his own website a link to his individual page on this directory (backlink). The translator is free to choose where this link to the sworn translators’ directory will be inserted on his own website.

2.8 The translator's data will be published in the French and Dutch directories www.traducteur-jure-belge.be, www.belgische-beedigde-vertaler.be, www.traducteur-interprete-belge.be and www.belgische-vertaler-tolk.be only after receiving his confirmation in the Registration Form or in an email after registration. This service is included in the registration fee.

2.9 The translator can send the company his CV in Word or PDF format. The CV sent will be in French, English and Dutch, in order to be inserted in the respective versions of this directory, if appropriate. Links will give visitors the opportunity to download them on the translator's individual pages.

2.10 The translator can send the company his photo and logo in .jpeg or .png format. The photos attract more visitors (the contact will be facilitated) and are necessary for his eventual advertisement in the photo gallery.

2.11 By sending the Registration Form, the translator declares on his honour that he is a sworn translator by a Belgian court for the language pairs mentioned in the form and that he accepts these Registration Conditions.

2.12 The translator’s own commercial conditions make the company liable only if the company has explicitly acknowledged these.

2.13 The translator commits to work with the utmost care and professional seriousness demanded by the deontological code and enforced principles in the profession of sworn translator, and in conformity with these registration terms and conditions.

2.14 In case of complaint, the translator agrees to the fact that no matter the bases of said complaints and the procedure undertaken to make it, the potential responsibility of the company for the execution of the obligations stated in these registration terms and conditions, will be limited to an amount not exceeding the total amount actually paid by the translator in payment for the services or tasks provided by the company.

2.15 Any modification in the translator’s contact details must be announced in writing.

2.16 No matter the difficulty the translator may be faced with over the course of his registration, he must urgently inform the company about it in writing.

2.17 Nevertheless, in the occurrence of the provisions stated in these terms and conditions are not being respected, both the translator and the company may apply their right to terminate the on-going registration.

2.18 Payments made are refundable only before the translator's data is published on the Internet.

2.19 No refund will be made after the translator's data has been published in these directories on the Internet.

2.20 Should the translator wish to delete his/her contact details from the website www.belgian-sworn-translator.be before the end of the duration already paid for, he must inform the company in writing. His contact details will be deleted from the website within 3 working days. Even in such a situation, payments having been made at the time of termination cannot be refunded, since his data have already been published on the Internet.

2.21 The company commits to inform the translator 1 (one) month prior to his/her registration coming to an end.

2.22 The payment of the registration fee automatically renews the validity of his registration signed in advance. The invoice will be sent to him upon receipt of his full payment on one of the accounts mentioned in the Registration Form which can be downloaded from the "Registration" page of these directories.

2.23 Failing to pay for the fees imply that the translator renounces his registration to this website and his contact details will automatically be deleted.

3. Website registration fees

3.1 All registration fees and all charges for additional advertisements mentioned in these directories and in the Registration Form are 21% VAT included.

3.2 Payments can be made:

a. By bank giro/transfer

b. By PayPal

Payment details are provided in the Registration Form that can be downloaded from the "Registration" pages of these directories.

3.3 All transfer fees are at the translator's expense and depend on his bank and transfer rates charged by PayPal.

3.4 The translator will take into account the transfer fees and will ensure that the company receives the full amount mentioned in the Registration Form, not an amount reduced by the transfer fees. Otherwise, the translator's registration will be delayed until the receipt by the company of the full amount.

3.5 The translator will take into account the fact that his bank transfer can take a few days, according to his bank and the working days.

3.6 The translator will receive the invoice only upon receipt of full payment into the company's bank account or PayPal account mentioned in the Registration Form.

3.7 The translator's data will be published in these directories within 3 working days of receipt of all relevant documents and full payment to the bank account or PayPal mentioned in the Registration Form.  

4. Rights and obligations of the company

4.1 The company endeavours to have the website www.belgian-sworn-translator.be run in the best conditions and to ease contacts between translators and clients.

4.2 The company cannot be held responsible for a minimum of request for estimates and/or translation orders after the translator has registered on the website.

4.3 The company cannot publicly disclose the information given by the translator excepting those bound to be made public and mentioned in the Registration Form, without his consent. This doesn’t apply to cases in which the company is legally requested to disclose such information or cases in which such information is in or falls into the public domain independently from such information being disclosed by the translator or the company.

4.4 The company cannot be held responsible for the loss of documents due to fires, floods, natural disasters, burglary or theft.

4.5 The company cannot be held responsible for any damages and losses occurring whilst data are being transferred. The company uses an antivirus software which is regularly updated and cannot account for damages caused by potential computer viruses.

4.6 The company website may feature hyperlinks towards other websites. Given that the company has no control over what those websites contain, the translator acknowledges that the company cannot be held responsible for the products, services and information available on and/or from those websites in particular.

4.7 The website www.belgian-sworn-translator.be complies with the General Data Protection Regulation (GDPR), adopted by the European Parliament on 14 April 2016.

5. Conditions of translator recommendation by their clients

5.1 Submitting a recommendation

5.1.1. The company is entitled to post recommendations/assessments on all the websites the company supervises.

5.1.2. Recommendations are displayed from the most recent one to the eldest.

5.1.3. Clients can send their recommendations to c.radu@traductoris.com directly or send them to the translators whom they were in business with, who then pass them on to us abiding by these terms and conditions.

5.1.4. By these terms and conditions, you expressly authorize the company or its affiliated sites to use, copy and distribute the evaluations on the sites published by the company

5.1.5. You expressly renounce all rights and you acknowledge you have no objection to these recommendations being posted, used or exploited by us.

5.1.6. The company does not alter these recommendations and, within legal limits, will not be responsible or liable whatever the reason due to any future posting, use or diffusion. Moreover, the company does not check, support or approve the ideas and opinions expressed in those recommendations, which only reflect their authors’ opinions.

5.1.7. All decisions made on the basis of those recommendations featured on this service remain your full responsibility.

5.1.8. The company reserves the right to analyse, translate, refuse to publish and delete, at its sole discretion and without notice, any published or archived evaluation on its sites, at any time and for any reason, or to entrust these tasks to third parties. The different scenarios include, without limitation, the situations in which the company receives the complaint from a third party and/or has reason to believe that there has been a breach of the general conditions.

5.1.9. Should you have a complaint about the recommendations or texts posted on our websites, please send said your complaint together with as many details as possible to justify it to the following e-mail address: c.radu@traductoris.com.

5.1.10. Let us specify that the company reserves the right to request further information concerning the nature of a complaint and ask you for elements to verify your identity, if need be.

5.2 Conditions for sending an assessment

5.2.1. Recommendations are authorised in the following cases only:

a. You ordered a translation with a translator with the intention to finalise your custom;

b. You resorted to the services of a translator, which you are recommending;

c. Or you could bring another testimony forward concerning the purchase of a service with the recommended translator.

These three situations will hereafter be referred to as “purchasing experiences”.

5.2.2. A valid e-mail address and recommendation must be provided on every occasion.

5.2.3. Recommendations must always be related to the service in question.

5.2.4. A service can only be recommended if and when it has been performed.

5.2.5. Recommendations can only concern a purchase experience (consumption experience) dating back to less than six months before the recommendation was submitted.

5.2.6. When the recommended translator contacts us because he cannot link your recommendation to an actual order, when your recommendation has been signalled by our anti-dishonesty measures or in case of obvious errors, we shall potentially ask you to provide, within five working days, the proof of your order with the person being recommended. Failing to provide evidence will cause the recommendation in question to be deleted.

5.2.7. Moreover, you can customise your recommendation by providing personal data when you submit a recommendation. For reasons of confidentiality, those details will be displayed in a restricted way.

5.3 Assessment contents / recommendations

Recommendation must be free of the following mentions:

  1. Criminally reprehensible, inciting to perpetrate or cause an offence;
  2. Illicit, threatening, harassing, insulting, abusive, aggressive, hurtful, blasphemous, indecent, incorrect, inaccurate, defamatory, deceptive, racist, discriminatory, violent, shocking, obscene, sexist or pornographic;
  3. Including random characters or meaningless series of words or if the text is badly written to the point of being unintelligible;
  4. Whose attributes include concrete elements of conflicts of interests, violating or damaging the rights of third parties (particularly all intellectual property rights, for instance copyrights or trademark rights) and/or illegal in any other way;
  5. Containing information of a confidential nature and/or violating or damaging third parties’ confidentiality, particularly if the text in question includes a credit card, social security, bank account number or any other information likely to result in an identity theft;
  6. Deceiving third parties as to your identity (particularly by stealing a third party’s identity);
  7. Concerning a consumption experience dating back to more than six months before the recommendation was submitted;
  8. Bearing no direct link with the recommended services
  9. Not reflecting the client’s personal experience connected to the recommended products or services
  10. Promoting other websites, products or services
  11. It is forbidden to include telephone numbers, e-mail addresses or other links in the evaluations;
  12. Whose attributes include concrete elements of conflict of interest;
  13. Likely to influence legal proceedings you have knowledge of;
  14. Including an appeal of legal proceedings;
  15. Whose recommendation manager thinks they could jeopardise his/her civil or criminal liability;

For the afore-mentioned reasons, failing to do so causes the company to reserve the right to refuse, delete or cancel recommendations.

6. Competent jurisdiction and applicable law

6.1 The directory www.belgian-sworn-translator.be is governed and interpreted in accordance with Belgian, European and international laws.

6.2 By using this directory, its versions in different languages and by registering in these directories, you agree to comply with the registration conditions, the general conditions of use and navigation defined on these sites.

6.3 The invalidity of a clause contained within these registration conditions does not make other clauses invalid. The invalid clause is to be replaced, by mutual agreement or by a judge, by a clause as close as possible to the financial intent of the cancelled clause.

6.4 The safeguard clause only comes into effect in case other legal provisions cannot replace the provisions initially stated or when they only aim at facilitate interpreting those provisions.

6.5 Should the Registration Form and the registration conditions have been written up in various languages, the versions in French only prevails between the parties.

6.6 For any dispute relating to the validity, interpretation, execution or non-execution of the rights and obligations related to these conditions, Belgian law shall apply. In the event of failure of the amicable resolution, the French-speaking courts of Liège have sole jurisdiction to decide, unless otherwise provided by law.
