1 General provisions

1.1 The website www.belgian-sworn-translator.be is the property of Traductoris.com consulting agency, duly represented by Cornelia Radu, MSc ME..

1.2 The websites www.belgian-sworn-translator.be, www.belgische-beedigde-vertaler.be, www.belgian-translator-interpreter.be and www.belgische-vertaler-tolk.be are the English and Dutch versions of www.traducteur-jure-belge.be and www.traducteur-interprete-belge.be.

1.3 Traductoris.com  works in collaboration with non-profit organisation (ASBL) Productions Associées, having its head office in 1060 Brussels, Belgium, VAT: BE 0896.755.397.

1.4 These conditions for website registration apply to all commercial transactions and relations between Traductoris.com, owner and administrator of the website www.belgian-sworn-translator.be, referred to as “COMPANY” below ON THE ONE HAND and the sworn translator registering on the website, referred to as the “TRANSLATOR” ON THE OTHER.

1.5 All sworn translators with a Belgian court of Justice can register on this website. They have free decision regarding their rates and conditions for every order, as we do not act as intermediaries.

1.6 Sworn translators who also are interpreters can register on both websites: www.belgian-sworn-translator.be and www.belgian-translator-interpreter.be (please see point 3.3).

2 Duration of registration and steps to follow

2.1 A translator can register on the website www.belgian-sworn-translator.be for a period of one year (12 months from the date on which the registration takes effect) or more.

2.2 The exact duration of registration is in conformity with the registration form, filled in and dated by the translator upon registration.

2.3 To register, download HERE the registration form, fill it in, date, sign and e-mail it to: registration@belgian-sworn-translator.be. You will get a confirmation e-mail within 24 hours. Please feel free to contact us to receive the registration form by e-mail or by post.

2.4 The individual pages will be created, published on Internet and an invoice will be sent to the translator only upon reception of:

2.5 The translator is free to put an end to his/her registration at any time. Failing to pay for the fees implies that the translator renounces his/her registration to this website and his/her contact details will automatically be deleted.

2.6 Should the translator wish to delete his/her contact details from the website www.belgian-sworn-translator.be before the end of the duration already paid for, he/she must inform the company. His/her details will be deleted from the website within 3 working days. Even in such a situation, payments having been made at the time of termination cannot be refunded.

2.7 The company commits to inform the translator 1 (one) month prior to his/her registration coming to an end.

2.8 Paying registration fees prolongs the validity of the registration already signed.

3 Website registration fees

3.1 All our prices are VAT included.

3.2 The registration rate to the website www.belgian-sworn-translator.be is € 50.00/year (12 months from the date on which the registration takes effect), safe promotional offers or agreements between the company and the translator.  

3.3 Translators who also are interpreters can register on both sites: www.belgian-sworn-translator.be and www.belgian-translator-interpreter.be for € 70.00/year (12 months from the date on which the registration takes effect).

3.4 The price of your registration includes your pages in the languages of your choice: English, French and Dutch.  

3.5 The promotion of the sworn translator on the website(s) is free during the first month of registration but not afterwards; it then has to be paid for. The detail of the advertisement rates is available in the Registration Form.

3.6 Payments can be made:

4 Rights and obligations of the company

4.1 The company endeavours to have the website www.belgian-sworn-translator.be run in the best conditions and to ease contacts between translators and clients.

4.2 The company cannot be held responsible for a minimum of request for estimates and/or orders for translation after the translator has registered on the website.

4.3 The company cannot publicly disclose the information given by the translator and excepting those bound to be made public and mentioned in the registration form, without his/her consent. This does not apply to cases in which the company is legally requested to disclose such information or cases in which such information is in or falls into the public domain independently from such information being disclosed by the translator or the company.

4.4 The company cannot be held responsible for the loss of documents due to fires, floods, natural disasters, burglary or heft.

4.5 The company cannot be held responsible for any damages and losses occurring whilst data are being transferred. The company uses an antivirus software which is regularly updated and cannot account for damages caused by potential computer viruses.

4.6 The company website may feature hyperlinks towards other websites. Given that the company has no control over those websites contain, the translator acknowledges that the company cannot be held responsible for the products, services and information available on and/or from those websites in particular.

4.7 The website www.belgian-sworn-translator.be complies with the General Data Protection Regulation (GDPR), adopted by the European Parliament on 14 April 2016, applicable from 25 May 2018.

5 Rights and obligations of the translator

5.1 All sworn translators with a Belgian court of Justice can register on this website.  

5.2 By sending the Registration Form, the translator certifies he/she is a sworn translator with a Belgian court of Justice, for the languages he/she mentioned in that form.

5.3 The translator is free to take (or not) requests from clients and to set up his/her own delivery and payment conditions for each translation he/she makes.

5.4 The translator commits to work with the utmost care and professional seriousness demanded by the deontological code and enforced principles in the profession of sworn translator, and in conformity with these registration terms and conditions.

5.5 In case of complaint, the translator agrees to the fact that no matter the bases of said complaints and the procedure undertaken to make it, the potential responsibility of the company for the execution of the obligations stated in these registration terms and will be limited to an amount not exceeding the total amount actually paid by the translator in payment for the services or tasks provided by the company.

5.6 Any modification in the translator’s contact details must be announced in writing.

5.7 No matter the difficulty the translator may be faced with over the course of his/her being registered, he/she must urgently inform the company about it in writing.

5.8 The translator’s own commercial conditions make the company liable only of the company has explicitly acknowledged these.

5.9 By sending the Registration Form it is considered the translator has agreed to the registration terms and conditions.

5.10 Nevertheless, in the occurrence of the provisions stated in these terms and conditions are not being respected, both the translator and the company may apply their right to terminate the on-going registration.

5.11 The translator can send his/her CV (in Word or PDF format). A link will enable visitors to download it from his/her personal page.

6 Competent jurisdiction and applicable law

6.1 The contractual relations between the parties these terms and conditions apply to are exclusively regulated by Belgian law. In the occurrence of a dispute regarding the application or interpretation of these terms and conditions and failing to reach an out-of-court settlement, the Francophone courts of Liège are the only ones competent, unless the company, acting as plaintiff, prefers to bring the case to any other competent court.

6.2 The invalidity of a clause contained within these registration conditions does not make other clauses invalid. The invalid clause is to be replaced, by mutual agreement or by a judge, by a clause as close as possible to the financial intent of the cancelled clause.

6.3 Not questioning these clauses within 48 (forty eight) hours after having registered on the website imply they have been agreed to.

6.4 The safeguard clause only comes into effect in case other legal provisions cannot replace the provisions initially stated or when they only aim at facilitate interpreting those provisions.

6.5 Should the Registration Form and the registration conditions have been written up in various languages, the version in French only prevails between the parties.
